Terms of Use and Service

Yielded AI is a trading name of Aiden Goode (ABN 45 958 830 259).
Effective: 2026-11-02 | Version 1.3

1. About these terms

These terms apply when you use any Yielded AI website or service (the “Services”). The written quote you accept describes what we will deliver and what it costs. If the quote and these terms conflict, the quote applies to that service. If you have signed a separate services agreement with us, it applies instead of these terms wherever the two conflict.

2. Who can use the Services

You must be at least 18. If you use the Services for a business, you confirm you have authority to bind it.

3. Your account

Keep your login details secure. You are responsible for activity on your account unless it results from our failure to protect it. Tell us at support@yielded.io if you think someone else has accessed it.

4. The Services

4.1 We describe each Service in your written quote. We may improve or change features. If we remove or materially reduce a feature you have paid for, you can cancel and receive a refund of the unused part of what you paid.

4.2 We provide the Services with due care and skill. We cannot promise particular business results, such as leads, sales or revenue, because they depend on things we do not control. Figures shown on our website or in proposals are examples and are not promises about your results.

5. Prices and payment

5.1 Your price is set out in the written quote we give you after the free audit. Nothing is charged until you accept a quote.

5.2 All prices are in Australian dollars and exclude GST unless the quote says otherwise. We add GST at the current rate on your tax invoice.

5.3 Setup fees are invoiced 50% when you accept the quote and 50% at handover. Monthly fees are billed monthly in advance from the handover date. Invoices are due within 7 days.

5.4 Usage costs are not included in our fees unless the quote says so. These include text messages, calls, phone numbers, email sending, AI voice and chat minutes, ad spend, domains and third party tools. They are charged at cost plus 10%, or drawn from a prepaid balance you top up. Your quote shows estimated monthly usage.

5.5 We may change monthly fees with at least 30 days’ written notice. If you don’t accept a change, you can cancel before it takes effect without any minimum term charge.

5.6 Payments are processed by Stripe (cards) and NOWPayments (cryptocurrency). Their terms apply to the payment. If you pay in cryptocurrency, the network fee your wallet charges is not part of our price. We show the AUD price before you pay.

5.7 If a payment fails, we will tell you and give you 7 days to fix it before suspending anything.

5.8 Live in 14 days guarantee. If the service in your accepted quote is not live within 14 days of the later of (a) you accepting the quote and (b) you giving us the access, information and approvals we ask for, your first month’s fee for that service is free. Delays caused by you, your carrier or another third party outside our control pause the 14 days. This guarantee covers delivery time only, not business results.

5A. Term and cancellation

5A.1 Monthly services have a minimum term of 3 months from handover, unless your quote says otherwise. After that they run month to month.

5A.2 You can cancel with 30 days’ written notice to support@yielded.io. If you cancel during the minimum term, you pay the monthly fees for the rest of the minimum term and nothing more.

5A.3 When a service ends, we give you an export of your contacts, conversations and booking records on request within 30 days. We will help you transfer any phone number we set up for you, at the carrier’s cost. 60 days after the service ends we delete your data, except records the law requires us to keep.

6. Acceptable use

6.1 Do not use the Services to break the law, infringe others’ rights, send malware or spam, attempt to access systems or data that are not yours, or interfere with the Services. We may suspend access for serious or repeated breaches (clause 13).

6.2 If you ask us to send emails, text messages or calls to people on your behalf, you confirm that you have their consent where the law requires it, and that every message identifies you and has a working unsubscribe option. This includes the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth). We may pause or refuse any campaign that does not meet this.

7. Intellectual property and your data

7.1 We own the Services and their content, except material you provide. You keep ownership of what you submit. You give us a licence to use it only as needed to operate and support the Services for you.

7.2 If our Services handle personal information about your customers or callers, you decide how it is used and we handle it on your behalf. We will:

  • use it only to provide the Services to you;
  • keep it secure;
  • use only the kinds of providers listed in our Privacy Policy, and give you 30 days’ notice before adding a new kind of provider that will hold it;
  • tell you without undue delay, and within 72 hours, after we become aware of a data breach affecting it; and
  • help you respond to access, correction and complaint requests.

7.3 You confirm you are allowed to give us that information, that you have a privacy policy, and that you have given the notices and obtained the consents the law requires.

8. AI features and outputs

8.1 Some Services use AI. For our own support, AI systems draft replies, automated checks and a second AI system review them, and a person decides refunds and handles legal, payment, privacy and safety matters.

8.2 AI outputs can be wrong, incomplete or out of date. They are general information, not legal, financial, tax, medical or other professional advice. Check anything important with a qualified professional before you rely on it. This clause does not limit your rights under clause 11.

8A. AI receptionists and assistants we set up for you

8A.1 Before launch, you approve the assistant’s script, greeting and knowledge base. Tell us when your hours, prices or policies change so we can update it.

8A.2 An AI assistant can misunderstand callers or give wrong or incomplete answers. Check important details with your customers yourself.

8A.3 It is not an emergency service. It is set up to tell callers to hang up and call triple zero in an emergency.

8A.4 The assistant tells callers it is an AI and that calls are recorded. You must not ask us to remove those statements. You are responsible for any other notices your own customers need.

9. Third party services

The Services run on and may link to third party services, including our CRM, website, phone and AI receptionist platform, Hostinger, Cloudflare, Stripe, NOWPayments and our AI provider, Anthropic. We are not responsible for services we do not control, except where the law says we are.

10. Privacy

Our Privacy Policy explains how we handle personal information. It forms part of these terms.

11. Consumer guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies those rights.

To ask for a refund, email support@yielded.io. A person decides every refund request and tells you the outcome and the reasons in writing. We do not give refunds for a change of mind. That does not affect your rights under this clause.

12. Limits on our liability

To the extent the law allows, and subject to clause 11:

  • we are not liable for loss that was not reasonably foreseeable;
  • we are not liable for loss caused by events outside our reasonable control;
  • where the law allows us to limit liability for a failure to meet a consumer guarantee (for example for services not ordinarily acquired for personal, domestic or household use), our liability is limited to supplying the service again or paying the cost of having it supplied again; and
  • if you acquire the Services for a business, our total liability to you is limited to the fees you paid us in the 12 months before the claim arose.

Nothing in these terms limits liability that cannot lawfully be limited.

13. Suspension and ending

You can stop using the Services at any time under clause 5A. We may suspend or end your access if you seriously or repeatedly breach these terms, or if we must by law. Where practical, we will give you notice and a chance to fix the problem first. If we end your access for any reason other than your breach, we will refund the unused part of what you paid and no minimum term charge applies.

14. Changes to these terms

We may change these terms. For material changes we will give at least 30 days’ notice by email. If a change is materially adverse to you, you can cancel during the notice period, receive a refund of the unused part of what you paid, and no minimum term charge applies. Continuing to use the Services after the notice period means you accept the change.

15. Complaints and disputes

Contact support@yielded.io first. We acknowledge complaints within 2 business days and aim to resolve them within 15 business days. Nothing here stops you contacting a government agency, such as the consumer protection agency in your state or territory, or going to a court or tribunal.

16. Governing law

These terms are governed by the laws of the Northern Territory, Australia, and you and we submit to the courts of that place. This does not take away any right you have under the Australian Consumer Law or other law that cannot be excluded.

17. General

  • These terms, your accepted quote and the policies they refer to are the whole agreement about the Services.
  • If part of these terms is unenforceable, the rest still applies.
  • A failure to enforce a right is not a waiver of it.
  • We may transfer our rights and obligations to a related entity or a successor on at least 30 days’ notice. If the transfer makes you worse off, you can cancel and receive a refund of the unused part of what you paid.
  • We give notices by email to the address on your account or the address you used to contact us.
